What Is A Letter of Demand?

A letter of demand is a formal letter sent to the debtor providing them with an opportunity to pay the outstanding invoice without going to court.

A letter of demand outlines the crucial information including the current outstanding balance, who it is due to and the deadline for payment date. A letter of demand also informs the debtor what action will be taken should the debt not be paid by the due date.

When should a letter of demand be sent?

A letter of demand should be sent as a final warning prior to commencing legal action. Therefore, it is suggested that you as a business have already provided a friendly reminder via email or telephone. This offers the debtor an informal approach to ensure that the invoice has not been misplaced and allow them to correct their error.

Once a friendly reminder has been provided and the debt continues to remain unpaid, we would then recommend contacting Macquarie Collections to issue a formal letter of demand.

Why use a debt collection agency to send a letter of demand?

The purpose of a third party letter of demand is to create a sense of urgency in the mind of the debtor so that payment of your outstanding invoice becomes a priority. By involving a debt collection agency to act on your behalf makes the debtor know the importance of paying your invoice within a short period of time.
